This privacy policy complies with current Spanish and European legislation on the protection of personal data on the Internet. Specifically, it respects the following rules:

Processing of personal data

In compliance with the provisions of the RGPD and the LOPD-GDD, we inform you that the personal data collected by Balidea Consulting & Programming through the forms contained in the website will be processed in order to facilitate, expedite and fulfil the commitments established between Balidea Consulting & Programming and the user or the maintenance of the relationship established in the forms filled in by the user, or to respond to a request or query from the user. Likewise, in accordance with the provisions of the RGPD and the LOPD-GDD, unless the exception provided for in article 30.5 of the RGPD applies, a register of processing activities will be kept which, according to its purposes, will specify the processing activities carried out and the other circumstances established in the RGPD.

Principles governing the processing of personal data

The processing of the user's personal data is subject to the following principles, as set out in Article 5 of the RGPD and Articles 4 and following of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights:

  • Principle of lawfulness, fairness and transparency: the consent of the user is always required, after full and transparent information on the purposes for which the personal data are collected.
  • Principle of purpose limitation: Personal data is collected for specified, explicit and legitimate purposes.
  • Principle of data minimisation: the personal data collected is limited to what is strictly necessary for the purposes for which it is processed.
  • Principle of accuracy: Personal data must be accurate and kept up to date.
  • Principle of limited retention: personal data shall be kept in a form that allows the identification of the data subject only for as long as is necessary for the purposes of the processing.
  • Principle of integrity and confidentiality: personal data shall be processed in a manner that ensures its security and confidentiality.
  • Proactive accountability principle: The controller is responsible for ensuring that the above principles are complied with.
Categories of personal data

The types of information requested are Identification and contact details. In addition, the Site automatically collects browsing information as described in the Cookie Policy.

Balidea Consulting & Programming does not collect data of a sensitive nature, such as: racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health, sexual activity or sexual orientation, biometric or genetic data.

Legal basis for processing personal data

The legal basis for the processing of personal data is consent or other legal basis as specified in the relevant form.

Balidea Consulting & Programming undertakes to obtain the express and verifiable consent of the user to the processing of his/her personal data for one or more specific purposes.

The user has the right to withdraw consent at any time. Withdrawing consent shall be as easy as giving it. As a general rule, withdrawal of consent shall not be conditional on the use of the Website.

In those cases where the user must or may provide his/her data through forms in order to make enquiries, request information or for reasons related to the content of the website or the form, he/she will be informed in the event that the completion of any of them is compulsory because it is essential for the correct development of the operation being carried out.

The purposes for which the personal data will be used

Personal data are collected and processed by Balidea Consulting & Programming in order to facilitate, speed up and fulfil the obligations established between the website and the user, or to maintain the relationship established in the forms filled in by the latter, or to respond to a request or enquiry.

The data may also be used for commercial, personalisation, operational and statistical purposes and for activities that are part of the business purpose of Balidea Consulting & Programming, as well as for data extraction, storage and marketing studies to adapt the content offered to the user and to improve the quality, operation and navigation of the website.

At the time the personal data is collected, the data subject will be informed of the specific purpose(s) of the processing for which the personal data will be used, i.e. the use(s) to which the information collected will be put.

Retention periods for personal data

In the event that legal provisions require data to be retained for a certain period of time, the data will be blocked until the expiry of the retention period.

Personal data of minors

In accordance with the provisions of Article 8 of the GDPR and Article 7 of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights, only persons over 14 years of age may give their consent to the lawful processing of their personal data by Balidea Consulting & Programming. In the case of minors under the age of 14, the consent of their parents or guardians is required for the processing, which will only be considered lawful if they have given their consent.

Confidentiality and security of personal data

Balidea Consulting & Programming undertakes to adopt the necessary technical and organisational measures, according to the level of security corresponding to the risk of the data collected, to ensure the security of personal data and to prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or the unauthorised communication of or access to such data.

The website has an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, as the transmission of data between the server and the user is fully encrypted or scrambled.

However, given the state of the art, the nature of the data stored and the risks to which they are exposed, since it cannot be guaranteed that hackers or other persons will not fraudulently gain access to personal data, the Controller undertakes to notify the User or the competent authorities without undue delay in the event of a breach of security of personal data that is likely to result in a high risk to the rights and freedoms of natural persons. Personal data will be treated as confidential by the Data Controller, who undertakes to inform and ensure, by means of a legal or contractual obligation, that this confidentiality is respected by its employees, partners and any other person to whom it makes the information accessible.

Rights relating to the processing of personal data

The user may exercise against the data controller the following rights recognised by the GDPR and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital Rights:

  • Right of access: this is the right of the user to obtain confirmation as to whether or not Balidea Consulting & Programming is processing his or her personal data and, if so, to obtain information about his or her specific personal data and about the processing that Balidea Consulting & Programming has carried out or is carrying out, as well as, among other things, information available about the origin of said data and about the recipients of communications made or planned to be made with respect to said data.
  • Right of rectification: this is the right of the data subject to have his or her personal data rectified if it is found to be inaccurate or incomplete in relation to the purposes of the processing.

  • Right to restrict processing: this is the right of the data subject to restrict the processing of his or her personal data. The data subject has the right to restrict the processing if he or she disputes the accuracy of his or her personal data, if the processing is unlawful, if the controller no longer needs the personal data but the data subject needs it to make a claim, and if the data subject has objected to the processing.
  • Right to data portability: Where processing is carried out by automated means, the data subject shall have the right to obtain from the controller his or her personal data in a structured, commonly used and machine-readable format and to have it transmitted to another controller. Where technically feasible, the controller shall transmit the data directly to that other controller.
  • Right to oppose: This is the right of the user to oppose the processing of his/her personal data or to stop the processing of such data by Balidea Consulting & Programming.
  • Right not to be subject to a decision based solely on automated processing, including profiling: this is the right of the data subject not to be subject to an individualised decision based solely on automated processing of his or her personal data, including profiling, unless otherwise provided by law.
  • The right to lodge a complaint with the supervisory authority, which in the case of Spain is the Spanish Data Protection Agency.

In cases where representation is permitted, it will also be necessary to identify the person representing the User by the same means, as well as the document authorising the representation. Use of the website implies acceptance of the Privacy Policy of the same.

Balidea Consulting & Programming reserves the right to modify its privacy policy, according to its own criteria or motivated by a legislative, jurisprudential or doctrinal change of the Spanish Data Protection Agency. Changes or updates to this policy will not be expressly communicated to the user. The user is advised to consult this page regularly in order to be aware of any changes or updates.
